RENTAL CONDITIONS / REGULATIONS

  1. The customer/lessee declares that he/she has personally verified that the rental goods are suitable for the agreed-upon use, are in good condition and have been adjusted to his/her needs. He/she undertakes to use the rental goods with the ordinary diligence of a good father of a family, for the agreed-upon use on the ski slopes. The customer/lessee is expressly prohibited from subleasing the goods covered by this agreement or renting them to others.

  2. The customer/lessee is the custodian of the rental property for the entire duration of the contract and assumes full responsibility for the rental property in the event of theft or loss. In the event of theft, the customer/lessee is required to immediately report the theft to the competent authorities and provide a copy to the lessor. The customer/lessee is responsible for fully refunding the lessor for the value of the rental property that is stolen or lost. The amount to be refunded is determined based on the market values ​​of rental property as provided by the industry magazine "Sciare."

  3. The rental is for the agreed-upon period indicated on the receipt attached to these regulations. Failure to return the rented items at the end of the rental period will result in the customer/lessee being charged an additional amount equal to the daily rental fee for each day of delay, plus a penalty of €100,00.

  4. In the event of partial damage to the rented goods due to the customer's negligence, improper use, inadequate treatment, and/or vandalism, the costs of restoring the goods to their normal condition or replacing them if they are unusable will be borne entirely by the lessee.

  5. The lessee is fully responsible for any extraordinary maintenance work on the rental property resulting from improper use and/or any modifications requested during the rental period.

  6. The customer/renter declares to be aware of the current regulations regarding mountain sports activities—including competitive ones—and the recently amended and supplemented legal provisions (Legislative Decree 40/2021 and subsequent amendments), which require the use of appropriate electronic signaling and search systems, a shovel, and a snow probe to ensure adequate rescue operations. Any liability related to the failure to rent and/or use of such equipment is therefore the sole responsibility of the customer/renter.

  7. The customer-tenant's personal data will be used exclusively in connection with and in fulfillment of this contract. The aforementioned data will be processed using manual, computerized, and electronic means, with methods strictly related to the purposes of the contract.

  8. Any disputes that may arise regarding the application and interpretation of the rental agreement and these regulations will be subject to the exclusive jurisdiction of the Court of Trento.

The above-mentioned terms and conditions 1), 2), 3), 4), 5), 6), 7), 8) have been agreed upon and are expressly approved by the parties also pursuant to Articles 1341 and 1342 of the Civil Code.
